Welcome to ACHVR’s Terms & Conditions. Your use of ACHVR’s services and website (referred to collectively as the “Services”) is subject to the Terms of Use. “ACHVR” is powered by Global IT Service Provider that provides tech related training and internship services in India and includes all its subsidiaries. These terms and conditions (“Terms and Conditions”), are between ACHVR and you and hence agree to be bound by the provisions of these Terms and Conditions.

Please read these Terms and Conditions, along with the Privacy Policy and all other rules and policies made available or published on ACHVR Platform as they shall govern your use of the ACHVR Platform. By using or browsing or visiting the ACHVR Platform or any ACHVR software, data feeds, and service provided to you on, from, or through the ACHVR Platform, you signify your acceptance to (i) These Terms and Conditions apply to all Users of the ACHVR Platform, including educators/Trainers/tutors who are also contributors of User Content on the Platform and also trainees and/or interns i.e., the ultimate user., (ii) ACHVR Privacy Policy and any other terms that are updated from time to time.

If you do not agree to any of these terms, please do not use the ACHVR Platform.

  1. These Terms and Conditions apply to all Users of the ACHVR Platform, including educators/Trainers/tutors who are also contributors of User Content on the Platform and also trainee and/or intern i.e., the ultimate user, i.e. trainee and/or intern.  
  2. ACHVR Platform is an online/offline platform that supports and facilitates the online creation of educational videos/or tutorials, by the Users of the Platform and acts as an intermediary between the educator/trainer/tutor and the ultimate User. A User may create a video, audio clip or tutorial, by using the ACHVR through any tool. Such content uploaded through the use of the ACHVR shall hereinafter be referred to as “User Content”. You agree and acknowledge that ACHVR has no control over and assumes no responsibility for the User Content and by using the ACHVR, you expressly relieve ACHVR from any and all liability arising from the User Content.
  3. The Platform may include or contain links to any third-party websites that may or may not be owned or controlled by ACHVR. ACHVR has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, ACHVR will not and cannot censor or edit the content of any third-party site.
  4. ACHVR may terminate User’s access at any time for any reason whatsoever. The provisions regarding a disclaimer of warranty, accuracy of information and indemnification shall survive such termination. ACHVR shall continuously monitor access to the website.
  5. Subject to these Terms and Conditions, Privacy Policy and all other rules and policies made available or published elsewhere, ACHVR hereby grants you a non-exclusive, non-transferable, non-sub licensable, limited license to use the Platform in accordance with these Terms and Conditions.
  6. You agree and acknowledge that ACHVR shall have the right at any time to change or discontinue any aspect or feature of the Platform, including, but not limited to, the User Content, hours of availability and equipment needed for access or use. Further, ACHVR may discontinue disseminating any portion of information or category of information may change or eliminate any transmission method and may change transmission speeds or other signal characteristics.
  7. In order to access some of the features of the ACHVR, you may have to create your account with ACHVR. You agree and confirm that you will never use another User’s account nor provide access to your account to any third-party. When creating your account, you confirm that the information so provided is accurate and complete. Further, you agree that you are solely responsible for the activities that occur on your account, and you shall keep your account’s password secure and not share the same with anyone.
  8. ACHVR hereby grants you permission to access and use the Platform as set forth in these Terms and Conditions, provided that:
  • You agree not to distribute in any medium any part of the Platform or the content without ACHVR’s prior written authorization.
  • You agree not to alter or modify any part of the Platform.
  • You agree not to access content of any other User through any technology or means other than the video playback pages of the Platform itself.
  1. You agree to receive installs and updates from time to time from ACHVR. These updates are designed to improve, enhance and further develop the Platform and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit ACHVR to deliver these to you) as part of your use of the ACHVR.
  2. You may post reviews, comments and other content; send other communications; and submit suggestions, ideas, comments, questions or other information as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringement of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam. ACHVR reserves the right to change or discontinue any aspect and portion of the ACHVR Platform at any time with or without notice at its sole discretion, including its content or features.
  3. ACHVR reserves the right to change the terms and conditions applicable to the use of the website. Such changes shall be effective immediately without notice, which shall be placed on the website.
  4. In addition to the general restrictions mentioned above, the following limitations and conditions shall apply to your use of the Content.
  • ACHVR Content utilized on the Platform which shall include but not be limited to trademarks, service marks and logos (“Marks”), process, images, software, graphics are owned by or licensed to ACHVR and subject to copyright and other intellectual property rights under the law.
  • User Content, information, materials, software, products and services provided offline or on website is provided to you on an “AS IS” and “AS AVAILABLE” basis. You may access Content for your information and personal use solely as intended through the provided functionality on the Platform and as permitted under these Terms and Conditions. You shall not download any User Content unless you see a “download” or similar link displayed on the Platform for that User Content. ACHVR disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  • ACHVR has no responsibility for any damage to a User’s computer system or loss of data that result from the download of any content, materials, information from the website or otherwise.
  • All content, graphics, images, pictures etc. present on the website is the sole and exclusive property of ACHVR. The software, text, images, graphics, video and audio used on the website or otherwise belong to ACHVR.
  • You shall not copy, reproduce, make available online/offline or electronically transmit, publish, adapt, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any User Content for any other purposes other than as provided herein without the prior written consent of ACHVR or the respective licensors of the User Content.
  • You understand that when using the Platform, you will be exposed to User Content and/or information services from a variety of sources and by different Users, and that ACHVR is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Content.
  1. As an ACHVR User, you may submit User Content on the Platform, including videos and User comments. You understand that ACHVR does not guarantee any confidentiality with respect to any User Content you submit.
  2. You shall be solely responsible for your own User Content and the consequences of submitting and publishing such User Content on the Platform. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content that you submit.
  3. In any event ACHVR will not be liable for damages of any kind, including without limitation, direct, incidental or consequential damages (including, but not limited to, damages for loss of profits, business interruption and loss of programs or information) arising out of the use of ACHVR’s website, or any information provided thereon, or in the Products or Services, any claim attributable to errors, omissions or other inaccuracies in the Product or interpretations thereof.
  4. The User agrees to indemnify, defend and hold ACHVR harmless from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, arising out of or relating to any misuse by the User of the content and services provided by it onsite or offsite. ACHVR disclaims all warranties as to the accuracy, completeness or adequacy of information contained in the website or otherwise. ACHVR makes no warranty (a) that the website will meet your requirements; (b) that the website will be available on an uninterrupted, timely, secure, or error-free basis; (c) that the results that may be obtained from the use of the website or any services offered through the website/offline will be accurate or reliable.
  5. ACHVR shall at its sole discretion withhold or stop any and all payments that are to be made to such User and evaluate the pay-outs. Payments shall only be made for all legitimate work that is not subject matter of any violation or dispute.
  6. All rights herein are reserved. Unauthorized use of the materials appearing on this website or offline or otherwise may violate copyright, trademark and other applicable laws, and could result in criminal and/or civil actions. ACHVR is a registered trademark of Vizyprint. This trademark shall not be used in any manner whatsoever.
